1. Acceptance of Terms

By creating an account or using PersonaBuddy ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use PersonaBuddy. By using the Service you confirm you meet this requirement.

3. Your Account

You sign in via Google or GitHub OAuth. You're responsible for activity on your account. We may suspend or terminate accounts that violate these Terms.

4. Tokens, Plans & Payments

• Generating a character image consumes Tokens, deducted from your daily free balance first, then your paid balance.
• Tokens are granted through: a one-time signup bonus, a daily free grant (only while you have no active paid plan), referrals, subscription plans, and one-time token top-ups.
• Subscription plans renew for their stated period (weekly, monthly, 6 months, or yearly) until cancelled. Cancelling stops future renewal charges — tokens already granted to your account remain yours and don't expire on cancellation.
• Purchases (subscriptions and token top-ups) are non-refundable once tokens have been credited to your account, except where required by law.
• We reserve the right to change prices or token allocations for future purchases; changes do not affect tokens you already own.

5. Acceptable Use

You may not use PersonaBuddy to generate content that is illegal, infringes on real people's likeness without consent, depicts minors inappropriately, or violates the rights of others. We may remove content or suspend accounts that violate this policy.

6. Generated Content Ownership

Subject to your compliance with these Terms, you own the images you generate through PersonaBuddy and may use them per your plan's license (commercial use requires an active Premium plan, see the Plans page).

7. Third-Party Services

Image generation is powered by Google's Vertex AI (Gemini models). Authentication uses Google and GitHub OAuth. Payments (when enabled) are processed by Stripe and/or PayPal — we never store your card details.

8. Service Availability

PersonaBuddy is provided "as is." We don't guarantee uninterrupted availability and may modify or discontinue features at any time.

9. Limitation of Liability

To the maximum extent permitted by law, PersonaBuddy and SmartBuddy Inc. are not liable for indirect, incidental, or consequential damages arising from your use of the Service.

1. What We Collect

• Account info: name and email address from Google/GitHub OAuth sign-in.
• Character data: the character details you enter (name, appearance choices, style) and any reference photo you upload.
• Generated content: images produced by the Service and the prompts used to create them.
• Usage & billing data: token balance, plan status, referral activity, and transaction records (once real payments are enabled).

2. How We Use It

We use your data to operate the Service: authenticate you, generate and store your characters, track token/plan balances, and process payments. We do not sell your personal data.

3. Reference Photos & Generated Images

Photos you upload are used only to generate your character and are stored tied to your account. Generated images are stored so you can revisit your Character Bible and history at any time.

4. Third Parties We Share Data With

• Google Cloud / Vertex AI — processes your prompts and reference photos to generate images.
• Google / GitHub — used only for authentication (OAuth); we receive your name and email, nothing else.
• Stripe / PayPal — will process payment details directly when real billing is enabled; PersonaBuddy never sees or stores your card number.

5. Data Retention

We keep your account, characters, and generated images until you delete your account or ask us to remove them.

6. Your Rights

You can request a copy of your data or ask us to delete your account and associated data at any time via the "Talk to Our Team" form.

7. Cookies & Sessions

We use a session cookie to keep you signed in. We don't use third-party advertising trackers.

8. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the latest revision.
